Just as each neighborhood in the Barton Creek community has a different character, each property owners association is governed by its own set of Deed Restrictions and Design Guidelines. Each owner should receive copies of all governing documents pertaining to their property at the time of purchase. The governing documents include:
Master Declaration
The Master Declaration establishes the areas to which the deed restrictions apply, establishes voting rights of members and explains assessment units. This document also outlines the authority of the Architectural Control Committee.
Development Area Declaration of Covenants, Conditions, and Restrictions
The Declaration for each association outlines specific deed restrictions for Architectural Control and explains owner's responsibilities. This document contains very specific information such as setback requirements, land use and other environmental requirements.
Integrated Pest Management Plan
An IPM plan explains how to use pesticides to properly protect water quality. Environmental protections are extremely important in the Barton Creek community. The IPM plan should be provided to your landscape maintenance professional.
10A Assessments
Each property at Barton Creek is subject to an annual assessment for maintenance of endangered species habitat in the community. This obligation falls under the U.S. Fish and Wildlife Development Permit and the Endangered Species Act.
Articles of Incorporation and Bylaws
Each property owners association is a non-profit corporation subject to their applicable Articles of Incorporation and Bylaws that establish powers of and membership in the organization.
Design Guidelines
Each Architectural Control Committee reviews plans for any improvements to homes and yards in the community and compares them to the standards set forth in the applicable Design Guidelines. Homeowners should be familiar with the Guidelines for their neighborhood. It's strongly recommended that a homeowner provide a copy of guidelines to their architect, landscape architect, builder and/or designer so that designs are in compliance with the Guidelines and so that redesign fees can be reduced or eliminated.
Property Owner Requirements for Barton Creek Country Club Membership
Various properties and neighborhoods at Barton Creek are subject to differing requirements as to membership in the Barton Creek Country Club.
